These terms govern your use of Cardy, a platform for searching, tracking, buying, selling and trading collectible trading cards. By using the service you accept them in full. Please read the sections on Cardy's role and on buyer rights carefully, because they determine which protections you have and which you do not.
Cardy is operated by [RAGIONE SOCIALE], VAT number [PARTITA IVA], registered at [INDIRIZZO SEDE LEGALE]. You can reach us at support@cardy.trade.
Cardy connects buyers and sellers, but it does not sell cards and never owns them. The contract of sale is formed directly between buyer and seller; we are not a party to it. We do not verify the authenticity, existence or condition of the cards listed, nor the descriptions sellers write. Responsibility for the card sold, for its conformity with the description, and for shipping therefore rests entirely with the seller.
To use Cardy you must be at least 18 and provide accurate, up-to-date information. You are responsible for keeping your credentials confidential and for activity carried out through your account. You can delete your account at any time from your settings, unless you have open obligations to other users. We may suspend or close an account that breaches these terms or the law, attempts to defraud other users, or posts unlawful content: except in urgent cases or where the law requires otherwise, we will tell you why and you may challenge the decision by contacting us. Cardy is available in Italy, France, Germany, Spain, the Netherlands, Belgium, Austria, Portugal, Ireland and Luxembourg: to buy or sell you must have a delivery address in one of these countries. We may change the list of supported countries, giving notice through the service.
The buyer pays the price shown in the listing plus the shipping cost set by the seller, with nothing added on top. Cardy retains a 2.5% commission from the seller's proceeds, calculated on the card price only and never on shipping. Payments run through Stripe: the amount is held until the buyer confirms delivery or, if no confirmation and no dispute arrive, until 14 days have passed since payment, after which it is released to the seller net of the commission. Before you can sell, you must complete Stripe payment setup, including identity verification.
Cardy may be used to sell in a private capacity only. Selling in the course of a business, trade or profession is not permitted: if you sell on a regular, organised and profit-seeking basis, this platform is not for you and we may suspend your account. By selling on Cardy you confirm that you lawfully own the cards, that they are genuine, and that they do not come from unlawful activity. You undertake to describe their condition, language and edition accurately, to ship promptly after payment, and to package them well enough to protect them. Listing counterfeit, reproduced or stolen cards, describing cards misleadingly, posting fake listings, or manipulating prices or reviews is prohibited. You are responsible for meeting the tax obligations arising from your sales and for providing the tax details the law requires once you pass the reporting thresholds.
This point matters. Cardy may be used to sell in a private capacity only: selling in the course of a business is not permitted. Every purchase on the platform is therefore a sale between private individuals, to which neither consumer law nor the 14-day right of withdrawal applies, as those cover purchases from professional sellers only. You accordingly have no right to return a card because you changed your mind, and the applicable guarantees are those of a private sale under civil law. Your rights against a seller who sent you a card that does not match the description, or who never sent it at all, are of course unaffected.
If something goes wrong, first contact the other party from the order page: most problems are settled that way. If you cannot reach an agreement, you can open a dispute from the same page while the funds have not yet been released to the seller; opening one immediately halts the payout. Disputes do not resolve automatically: we review them case by case and will contact you. Our involvement consists of deciding whether to release the funds to the seller or refund the buyer, based on what both sides provide; it is not arbitration and does not affect your right to go to court.
Card-for-card trades involve no payment and do not go through Stripe: they are direct arrangements between two users, who exchange shipping addresses and undertake to send what they agreed. Cardy records the trade and tracks its status, but holds no security and cannot refund anything if one side fails to ship. Consider the other party carefully before accepting a trade.
The card values shown in your collection are estimates drawn from third-party market data, refreshed periodically and provided for information only. They are not an appraisal, a guarantee of resale value, or investment advice. Catalogue information may contain inaccuracies; card names, trade marks and images belong to their respective owners and are used for identification purposes.
Camera-based card recognition is provided as a convenience and works on a best-effort basis: we do not guarantee that a card will be identified, nor that the card suggested is the correct one. Results are always presented as candidates for you to confirm, and nothing is added to your collection without your explicit confirmation. You are responsible for checking that the card you select matches the one you own, particularly before listing it for sale. Recognition runs on our servers: the photo you take is transmitted for processing and is not retained.
Cardy is responsible for the operation of the platform, not for what users do on it. We are therefore not liable for the authenticity or condition of cards, for the conduct of buyers and sellers, or for loss or damage in transit. The service is provided without any guarantee of uninterrupted or error-free availability. Nothing in these terms excludes or limits our liability for wilful misconduct or gross negligence, for personal injury, or in any other case where the law does not permit limitation.
Cardy offers a free plan and paid subscription plans that renew automatically each period. You can change or cancel your subscription at any time from your billing settings: cancellation takes effect at the end of the period you have already paid for, which remains available to you. If you subscribe as a consumer you have a 14-day right of withdrawal; by starting the service immediately you agree that performance begins before that period expires, without prejudice to a proportionate refund for what you have not used.
We may update these terms as the product develops or to comply with the law. Where changes are substantial, we will tell you in the app or by email before they take effect; if you do not accept them you may delete your account. Continuing to use the service after they take effect means you accept the updated terms.
These terms are governed by Italian law. If you use Cardy as a consumer, the mandatory provisions of the law of your country of residence continue to apply where they are more favourable to you, and the courts of your place of residence have jurisdiction. Otherwise, the courts of the provider's registered office have exclusive jurisdiction. For disputes with professional sellers you may also use the European online dispute resolution platform at ec.europa.eu/consumers/odr.
For support, to report a listing or content you believe is unlawful, or to challenge a moderation decision, write to support@cardy.trade. We review every report and tell the reporter the outcome. Under Regulation (EU) 2022/2065 (Digital Services Act), support@cardy.trade is the single point of contact for users and for the authorities of the Member States, the European Commission and the European Board for Digital Services. Communication is accepted in Italian or English.
